Bombay High Court not allowing kidney donation by disabled boy
The Bombay High Court has denied the permission for kidney donation by a disabled boy to his brother.
The court was hearing the request of parents who wanted their mentally-challenged minor boy to donate a kidney to his sick brother.
The parents claimed that once the sick child recovers he will be able to take care of his brother who has mental disabilities.
The parents had also claimed that the mentally disabled boy had given his consent for the donation of one of his kidneys and he was not being forced into the act.
However, the court said that the minor boy was not fit enough to make a decision like this and that his decision making ability was affected due to his mental disability.
The court ruled that in case of people with mental disabilities, organ donations can’t be allowed.
